Address of the All-Ukrainian association of insolvency practitioners in connection with the campaign to support European integration

Europe is our home, the Europeans are our family,

our brothers in blood, origin and cultural background

Rapprochement with the European Union or close relations with Russia. The choice has arisen before Ukrainian people today. However, as events of 30 November demonstrated, it’s not a choice but rather a terrible misfortune that befell our people: public authorities have forgotten that they exercise power coming from the people and that power of the people is primary, universal and inalienable.

Under paragraph 3 Article 21 of the Universal Declaration of Human Rights of 1948 the will of the people should be the basis of the authority of government.

However, the current government of Ukraine does not consider will of Ukrainian people basis of its authority and does not see the people, even after having approached them cheek by jowl. The government disregards and neglects human rights and freedoms resorting to barbaric acts to keep the people in awe.

Article 35 of the French Declaration of the Rights of Man and the Citizen of 1789 provides that “when the government violates the rights of the people, revolt is a sacred right and urgent duty for the people and every part of them.”

The Universal Declaration of Human Rights of 1948 emphasizes that human rights should be protected by law in order to ensure that a person is not compelled to have recourse, as a last resort, to rebellion against tyranny and oppression.

Article 20 of the Constitution of Germany of 23 May 1949 lays down that “all the Germans have the right to resist to anyone who tries to eliminate the system provided that other means are not used.”

The Constitution of Portugal of 4 February 1976 states that “Portugal recognizes the right of the peoples to self-determination, independence and development, and the right to revolt against all forms of oppression” (Article 7).

In The Declaration of Independence of the United States of 1776 free people said: “We consider it apparent truth that all people are created equal , that the Creator gives them certain inalienable rights which are life , liberty and pursuit of happiness; governments are established to ensure these rights , and the authority of governments comes from the consent of those whom they govern. In every case when any form of power exercising becomes destructive, people have the right to modify or cancel it and create a new government basing on such principles and organizing its power in such a way that seems the most appropriate for the people to achieve safety and happiness. Discretion, of course , suggests not changing established governments for insignificant reasons. According to this postulate the whole past experience attests that mankind prefers to endure disaster until it’s bearable rather than stop it by changing usual way of life. However, when a range of violations and abuses of power  is always aiming at achieving the same goal, attesting to insidious plan to make people put up with unlimited despotism , the overthrow of such government and the creation of new security guarantees for the future becomes the right and duty of the people.”

In the 19th century famous Russian lawyer Anatolyi Koni in his thesis “On the right of self-defense” wrote, “the people, whose  government seeks to break state system, are entitled to the revolution by virtue of legal grounds for the right to self-defense. They have the right to revolt.”

Citizens of Ukraine, whose hearts are proud and free, violent actions of the government constitute weakness disguised as a force that will never break us but will only ignite the flames of people’s anger even harder.

Let’s save the precious gift of freedom for our posterity, stop lawlessness and misuse of power today. Our strength lays in our unity only.

Remember, our goal is to solve the problem by peaceful means.
